GENÉVRY / genevry.com – the online store operated by the Seller, through which purchases of GENÉVRY-branded products can be made via the genevry.com website.
Terms and Conditions – these terms and conditions governing purchases made in the genevry.com store.
Customer – any customer purchasing a product in the genevry.com store.
Consumer – a natural person who purchases goods from the Seller for a purpose not directly related to their business or professional activity.
Trader with Consumer Rights – a natural person who purchases goods from the Seller under a sales contract directly related to their business activity, where it is clear from the content of that contract that the purchase is not of a professional nature to them, having regard in particular to the subject matter of their business activity as disclosed in the Central Register and Information on Economic Activity.
2.1. Business activity
genevry.com sells cosmetics of the GENÉVRY Switzerland anti-age line – Quantum C5 Serum, Hydrocode A5 Lift (day cream), Nocticode R5 (night cream), Anti-Age NC5 SPF 50, and the Gua Sha skincare accessory – over the internet. Orders can be placed via the genevry.com website and by e-mail.
2.2. Territorial scope
The services offered by genevry.com are available in Poland, the other member states of the European Union, and Switzerland. The ability to fulfil an order is determined based on the declared delivery location.
2.3. Buyers
The genevry.com offer is available to natural persons, legal persons, and other organisational units with legal capacity. To use the offer presented on the genevry.com website, the Customer must provide the data necessary to fulfil the order.
2.4. Product information
Information about products offered for sale on genevry.com, such as description, ingredients, directions for use, packaging volume, expiry dates, etc., is provided by the manufacturer of the GENÉVRY brand. genevry.com makes every effort to ensure this information is correct and up to date. Before using the products, the Customer is obliged to read the information provided by the manufacturer on the product packaging, including any contraindications.
2.5. Prices of goods
The prices of goods and delivery costs shown on genevry.com are gross prices. Orders delivered within the territory of Poland are quoted and settled in Polish złoty (PLN). Orders delivered to other European Union member states and to Switzerland are quoted and settled in euro (EUR). The order currency is determined automatically based on the declared delivery country and is displayed to the Customer before the order is placed. The GENÉVRY brand is offered by an entity operating under Swiss jurisdiction – each Customer should independently verify the regulations applicable in their country, including any required taxes and the applicable VAT rate.
2.6. Discounts, promotions, discount codes
2.6.1. A discount arising from a discount code issued by genevry.com does not, unless stated otherwise, combine with other discount programmes or promotions.
2.6.2. Special discounts may not be combined with other discount programmes or promotions unless the terms of a given promotion state otherwise.
2.6.3. Due to mathematical differences arising from converting discounts between net and gross prices, the value of the discount actually applied may differ from the granted discount value by up to 0.3% (three tenths of one percent).
2.6.4. genevry.com may introduce programmes offering additional benefits to Customers. The terms of participation in such programmes will be set out in a separate set of rules in each case.
2.6.5. genevry.com may send information about promotions by e-mail or SMS to Customers who have given their consent.
2.7. Order
An Order is understood as the Customer’s acceptance of the genevry.com offer using the store’s mechanisms, preceded by the selection of goods and the choice of payment method and delivery address.
2.8. Sales contract and applicable price
Sales contracts are concluded within the organised system for concluding distance contracts using the genevry.com store mechanisms. genevry.com sends the Customer an order number to the Customer’s e-mail address together with confirmation that the order has been placed.
2.9. Delivery, delivery costs, packaging costs
2.9.1. The cost of delivery and packaging is stated each time during the order placement process, depending on the declared delivery country. Detailed rates and delivery times are available on the Delivery and Returns page.
2.9.2. Depending on the declared delivery location, the order may be fulfilled through the courier company DPD or GLS, acting on behalf of genevry.com (GREEN REPUBLIC SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ).
2.9.3. Quantity limitations. genevry.com reserves the right to introduce a quantity limit on the purchase of certain goods or to make such purchase conditional on the value of the Customer’s order. The Customer is informed of any such limitations each time an order is placed.
3.1. Placing and accepting an order
An order is placed by selecting products offered for sale from the range available on genevry.com. Products are added to the shopping cart by clicking the “Add to cart” button.
3.2. Order acceptance
Acceptance of the Customer’s order will be confirmed electronically, i.e. by an e-mail sent to the address provided by the Customer when placing the order. The order confirmation will include, among other things: the order number, the delivery address, and the order value.
In justified cases (e.g. where the order value is significant, or where there are grounds to suspect that the person placing the order has provided false information), commencement of order fulfilment may be conditional on additional verification of the order by e-mail or phone.
3.3. Possibility of changing or cancelling an order
The Customer may request a change or cancellation of an order by contacting Customer Service without delay at [email protected]. A change or cancellation is possible only until the parcel has been handed over to the courier company.
3.4. Right of withdrawal
3.4.1. The Consumer and the Trader with Consumer Rights acknowledge that, pursuant to Article 27 of the Polish Consumer Rights Act of 30 May 2014 (Journal of Laws of 2014, item 827, as amended), they have the right to withdraw from a distance contract without giving any reason by submitting a statement to the Seller within 14 days of the date the Goods were delivered.
3.4.2. The right of withdrawal from a distance contract does not apply to goods delivered in sealed packaging which, once opened, cannot be returned for reasons of health protection or hygiene, if the packaging has been opened after delivery (Article 38(5) of the Polish Consumer Rights Act). This exception applies in particular to GENÉVRY cosmetics sold in packaging with a protective seal (shrink wrap, seal, or applicator membrane) – such a product cannot be returned once the seal has been broken.
3.4.3. The detailed rules, time limits, and procedure for returning goods and filing complaints are described on the Delivery and Returns page, which forms an integral supplement to these Terms and Conditions.
3.4.4. The right of withdrawal does not apply to a Customer who concluded the contract in connection with their own business activity (as a trader other than a Trader with Consumer Rights).
3.5. Delivery time
3.5.1. The delivery time depends on the declared delivery country. Detailed information on delivery times is available on the Delivery and Returns page.
3.5.2. The Seller does not dispatch orders on days that are statutory public holidays in Poland and reserves the right to designate additional days on which dispatch will be suspended, which will be announced on genevry.com.
3.6. Refusal to fulfil an order
3.6.1. genevry.com reserves the right to refuse to fulfil an order in the following cases:
3.6.1.1. There are clear doubts as to the identity of the Customer or the data provided by them.
3.6.1.2. The order could not be confirmed and genevry.com has determined that confirmation was required pursuant to clause 3.2 above.
3.6.1.3. The Customer fails to comply with these Terms and Conditions.
3.6.1.4. The order cannot be fulfilled for logistical reasons, including lack of availability of the goods.
3.6.2. The Customer is notified without delay by e-mail of any refusal to fulfil an order, and any amount paid in advance is refunded in full.
3.7. Invoices
3.7.1. The Seller may issue a VAT invoice to a VAT payer only if the Customer provides their VAT (EU VAT) number when placing the order; otherwise, the Seller will not be able to subsequently issue an invoice bearing the Customer’s VAT number.
3.7.2. VAT invoices covering all items delivered under an order, as well as corrective invoices, are issued in electronic form and sent to the e-mail address provided by the Customer when placing the order.
3.7.3. By placing an order, the Customer accepts that the VAT invoice and any corrective invoice relating to that order will be issued in electronic form.
3.7.4. The Customer authorises GREEN REPUBLIC SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ to issue VAT invoices without the recipient’s signature.
3.7.5. Orders delivered to other European Union member states are settled in accordance with the EU VAT One Stop Shop (OSS) procedure, where applicable to the transaction in question.

4.3. genevry.com advises that, in certain cases, depending on the delivery country or the range of goods covered by a given order, some payment methods may not be available due to restrictions arising from agreements between genevry.com and the relevant payment service provider.
5.1. Carrier
5.1.1. Deliveries are carried out by the courier companies DPD (Poland and certain EU countries) and GLS (other EU countries and Switzerland).
5.1.2. The carrier may release the order to the Customer or to any other person present at the address indicated by the Customer.
5.2. Customer absence
If the Customer is not present at the indicated delivery address, the courier will leave a notice and make a further delivery attempt in accordance with the relevant courier company’s procedures. If delivery is unsuccessful, the parcel will be returned to the Seller, and genevry.com will contact the Customer to arrange next steps. Except in cases of non-performance or improper performance of the contract by the Seller, liability for the courier’s actions in delivering the parcel to the Customer rests with the courier company.
5.3. Detailed delivery rates and timeframes are described on the Delivery and Returns page.
6.1. The Seller is obliged to deliver to the Customer goods free from defects.
6.2. In the event of a discrepancy between the delivery and the order placed, or in the event of damage to the goods in transit, the Customer should contact Customer Service without delay at [email protected].
6.3. In the event of non-conformity of the goods with the contract, the buyer has the right to demand replacement of the goods, a price reduction, or withdrawal from the contract, in accordance with the provisions of the Polish Consumer Rights Act.
6.4. The complete rules for submitting complaints, the time limits for handling them, and the rules for returning goods are described on the Delivery and Returns page, which forms an integral part of these Terms and Conditions.
6.5. genevry.com informs the Customer of the possibility of using out-of-court means of handling complaints, including, after the complaint procedure has ended, submitting an application to initiate mediation or an application for the case to be heard before an amicable court at the competent Provincial Inspectorate of Trade Inspection. A Customer who is a consumer may also lodge a complaint via the EU’s online ODR platform, available at ec.europa.eu/consumers/odr.
7.1. Obligation to provide accurate information
A Customer using genevry.com’s services is prohibited from providing false data. genevry.com is not liable for failure to perform the service in such a case.
7.2. Delivery of e-mail messages
genevry.com is not liable for failure to deliver a message sent to the e-mail address provided by the Customer, which may be caused by e-mail blocking or filtering software installed on the Customer’s computer, blocking by mail server administrators, or other technical failure.
7.3. Refunds
Where an order is refused pursuant to these Terms and Conditions, or where products ordered and paid for by the Customer are unavailable, genevry.com will make a full refund of the amount paid to the account indicated by the Customer.
7.4. Nature of the cosmetic products
Information presented on genevry.com regarding cosmetic products is descriptive in nature and does not constitute medical advice or a promise of any particular therapeutic effect. GENÉVRY products are cosmetics within the meaning of applicable law; they are not medicines or medical devices. Before use, read the information on the packaging, including the ingredient list and any contraindications, and consult a physician or dermatologist in case of doubt.
7.5. Amendments to the Terms and Conditions
7.5.1. genevry.com reserves the right to amend these Terms and Conditions with effect for the future for important reasons, in particular: a change required by law, the introduction of new store functionality, a change to existing store functionality, or the introduction of new rules for making purchases.
7.5.2. Amendments to the Terms and Conditions are published on genevry.com and take effect 14 days after publication.
7.5.3. Orders placed but not yet fulfilled before the new Terms and Conditions take effect are governed by the version of the Terms and Conditions in force at the time the order was placed.
7.6. Disputes
Disputes are resolved by the competent common court determined in accordance with the Polish Act of 17 November 1964, the Code of Civil Procedure (Journal of Laws of 1964, No. 43, item 296, as amended).
7.7. The Seller does not consent to the paid resale by the buyer of purchased goods to consumers within the buyer’s own business activity.
